I-9 ComplianceWhat’s New with Form I-9 in 2025?

As of January 20, 2025, the U.S. Citizenship and Immigration Services (USCIS) released a new version of Form I-9. It’s valid through May 31, 2027, and includes a few important updates:

  • Revised descriptions for two List B identity documents
  • Updated statutory language in the instructions
  • A refreshed DHS Privacy Notice that aligns with current regulations

You can still use the August 1, 2023 version for now, but we recommend switching to the new one to stay current. You can grab the latest form directly from https://www.uscis.gov/i-9.

ICE Audits Are Heating Up

We’re seeing a renewed focus on immigration enforcement, and ICE audits are expected to increase this year. If your company receives a Notice of Inspection (NOI), you’ll have just three business days to produce your I-9 records.

Here’s what ICE is looking for:

  • Missing or incorrect information on forms
  • Incomplete or improperly verified documents
  • Unauthorized employment

And the penalties are no joke. Paperwork violations can cost up to $2,861 each, and knowingly employing unauthorized workers can run up to $28,619 per offense. If you’re a federal contractor or in a high-turnover industry, you’re especially on ICE’s radar. California employers—don’t forget that 72-hour notice posting requirement.

This HR Manager for a 5-Doctor Hematology Oncology Medical Practice with 130 employees shares the story of what an ICE audit was like for her.

Set aside time to review your I-9s regularly. Look for missing fields, outdated forms, or expired documents. If you’re not sure what to look for, consider bringing in an immigration attorney or a trained HR professional.

✅ Train Your Team

Make sure your HR staff knows how to complete and verify I-9s correctly. And for objectivity, avoid having the same person complete and audit the forms.

✅ Use E-Verify (If Applicable)

If you’re a federal contractor or in a state where it’s required, E-Verify is essential. It’s also a great way to add an extra layer of compliance. Just make sure your account is active and aligned with the 2025 Form I-9 updates. You can learn more at https://www.e-verify.gov/.

✅ Store I-9s Securely

Keep I-9s separate from personnel files and make sure they’re stored securely—whether that’s digitally or on paper. You’ll need to retain them for three years after hire or one year after termination, whichever is later.
